LSPN Names Dan Dixon Chief of Litigation
Dan Dixon has been named Chief of Litigation and Research at SSG Legal Sevices Corporation. This new appointment of Dan Dixon will assist the firm to provide exceptional legal consulting services. Mr. Dixon is a dynamic professional with an insatiable implementing criminal justice reform for all. As such, he will oversee the day-to-day Litigation Division and foster the firm’s strategic implementation process. SOUTH DAKOTA DISTRICT COURT ORDERS BOP TO
GIVE INMATES EARNED TIME CREDITS

Numerous federal inmates have filed 28 U.S.C. § 2241 petitions
demanding that the BOP is failing to grant them “Earned-Time” credits required under the FSA made into law on December 21, 2018. In O’Bryan v. Cox, Case No. CV-21-4052, U.S. Dist. LEXIS 167316 (D-SD Sept. 1, 2021), the petitioner argued that the BOP had failed to grant earned time credits for programming as authorized by the First Step Act.

The district court ruled that the BOP’s interpretation that the First Step Act sets a January 15, 2022, start date was unsupportable. The court said, “The FSA directs the BOP to phase in the entire pro¬gram for all prisoners. The phase-in ends on January 15, 2022. 18 U.S.C. § 3621(h)(2). During the phase-in period, the BOP is to provide prior¬ity to inmates based on the proximity of their release dates – no de¬ference is to be accorded to the BOP position that it need do nothing with accrued time credits under the FSA until January 15, 2022.”

In the end, the BOP was ordered to apply the petitioner’s earned time credits to pre-release custody or transfer the petitioner to supervised release by statute within the discretion of the Bureau of Prisons.
